Welcome to Urban Finds! The terms "we", "us" and "our" refer to Urban Finds. Urban Finds operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Urban Finds is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services. Nothing in these Terms limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act.

Section 1 – Access and account

By agreeing to these Terms, you represent that you are at least 18 years old, or that you are using the Services with the consent of a parent or guardian. You agree that all information you provide is correct, current and complete. You are responsible for keeping your account credentials secure and for all activity on your account.

Section 2 – Our products

We make every effort to represent our products accurately. Colours or product appearance may differ slightly from how they appear on your screen. Product descriptions may change without notice, and we may discontinue any product or limit quantities at our discretion.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Urban Finds may accept or decline your order. Your order is not accepted until we confirm acceptance, and we must receive your payment before your order is accepted. If we do not accept, change or cancel an order, we will contact you using the email, billing address and/or phone number provided with the order. Your purchases may be returned or exchanged in accordance with our Return & Refund Policy.

Section 4 – Prices and billing

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when you place your order, as shown in your order confirmation email. All prices are in South African Rand (ZAR). Any shipping charges are shown at checkout. You agree to provide current, complete and accurate payment information and confirm that you are authorised to use the payment method you provide.

Section 5 – Shipping and delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by couriers or events outside our control. Please see our Shipping Policy for details.

Section 6 – Intellectual property

The Services, including all trademarks, text, images, graphics and design, are owned by Urban Finds, its affiliates or licensors. You may use the Services for personal, non-commercial use only and may not reproduce, distribute or republish any material without our prior written consent. Shopify's name and logo are trademarks of Shopify; all other names and logos belong to their respective owners.

Section 7 – Optional tools and third-party links

We may provide access to third-party tools or links to third-party websites, which we do not monitor or control. These are provided "as is", and any use of them is at your own risk. Please review the third party's terms and policies before using them.

Section 8 – Relationship with Shopify

Urban Finds is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Urban Finds. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Urban Finds, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Urban Finds.

Section 9 – Privacy policy

All personal information we collect through the Services is subject to our Privacy Policy and, where applicable, Shopify's Privacy Policy. We process personal information in line with the Protection of Personal Information Act (POPIA).

Section 10 – Feedback and reviews

If you send us feedback, reviews or suggestions, you allow us to use them to operate and improve the Services. Your feedback must not be unlawful, misleading, abusive or infringe anyone's rights. We may remove feedback that breaches these Terms.

Section 11 – Errors, inaccuracies and omissions

Information on the Services may occasionally contain errors relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct these errors and update information or cancel orders if information is inaccurate, including after you have submitted your order. If we cancel a paid order, you will receive a full refund.

You may use the Services for lawful purposes only. You may not use the Services to break any law, infringe intellectual property rights, harass or harm others, transmit false information, spam, upload malicious code, scrape or collect data, or interfere with the security of the Services. We may suspend or terminate your account if you breach these Terms.

We may terminate these Terms or your access to the Services at any time. You remain liable for all amounts due up to the date of termination.

Section 14 – Disclaimer and limitation of liability

To the extent permitted by law, the Services are provided "as is" and "as available". To the fullest extent permitted by law, Urban Finds, its affiliates, partners and service providers, and Shopify, will not be liable for any indirect, incidental or consequential loss arising from your use of the Services. Nothing in these Terms excludes or limits any liability or consumer rights that cannot be excluded or limited under South African law, including your rights under the Consumer Protection Act.

Section 15 – Indemnification

You agree to indemnify Urban Finds, Shopify and our affiliates against third-party claims arising from your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Services.

Section 16 – Severability, waiver and entire agreement

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. These Terms and our posted policies form the entire agreement between you and us regarding the Services.

Section 17 – Governing law

These Terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of the South African courts.
